1. Introduction
These Terms and Conditions (“Terms”) govern the services provided by JAPCAR ENTERPRISE (“Company,” “we,” “us,” or “our”) to clients (“you” or “your”) seeking to import vehicles from Japan to the United Kingdom. By engaging our services, you agree to be bound by these Terms.
2. Services Provided
- Sourcing vehicles through Japanese auctions and dealerships.
- Facilitating purchase transactions.
- Arranging shipping and logistics to the UK.
- Managing customs clearance and compliance with UK regulations.
- Coordinating necessary modifications and testing for UK roadworthiness.
- Assisting with DVLA registration and vehicle taxation.
3. Client Responsibilities
- Providing accurate and complete information regarding vehicle preferences and budget.
- Making timely payments as outlined in our payment terms.
- Ensuring compliance with all applicable UK laws and regulations related to vehicle importation.
- Arranging appropriate insurance coverage for the imported vehicle.
4. Payment Terms
- A non-refundable service fee of £[] is required upon engagement.
- Additional costs, including vehicle purchase price, shipping, customs duties, VAT, testing, modifications, and registration fees, will be communicated and must be paid as invoiced.
- All payments must be made in GBP unless otherwise agreed.
5. Vehicle Compliance and Modifications
- Individual Vehicle Approval (IVA) testing for vehicles under 10 years old.
- MOT testing for vehicles over 3 years old.
- Modifications such as speedometer conversion to MPH, headlight adjustments, and rear fog light installation.
We will coordinate these processes to ensure compliance.
6. Shipping and Delivery
- Shipping methods include Roll-on/Roll-off (RoRo) and container shipping, depending on vehicle type and client preference.
- Estimated delivery timelines range from [ to ] weeks, subject to factors such as vehicle availability, shipping schedules, and customs processing.
- We are not liable for delays caused by third parties or unforeseen circumstances.
7. Insurance
- We recommend obtaining comprehensive insurance coverage for the vehicle during transit and after arrival in the UK.
- We can provide referrals to insurance providers experienced in covering imported vehicles.
8. Limitation of Liability
- We act as an intermediary and are not liable for defects, damages, or discrepancies in the vehicles sourced.
- Our liability is limited to the amount of the service fee paid.
- We are not responsible for delays, losses, or additional costs arising from factors beyond our control.
9. Cancellation and Refund Policy
- The initial service fee is non-refundable.
- If you choose to cancel the import process after vehicle purchase, you may be responsible for any incurred costs.
- Refunds for other payments will be considered on a case-by-case basis.
10. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
